BLUE RIDGE MEN’S RETREAT
SECTION I — MEMBERSHIP AGREEMENT
1. Private Membership Status
Blue Ridge Men’s Retreat is a private membership organization operated by Wallace Haven, LLC. Membership grants access privileges only and does not create tenancy, ownership, or equity interest. Membership is limited to 500 active members.
2. Eligibility
Members must be 21 years of age or older. Membership is personal and non-transferable. No guest passes are permitted; all visitors must be active members.
3. Code of Conduct & Consent
Members agree to treat all individuals with respect, obtain clear consent before physical interaction, follow all posted rules, and refrain from harassment, discrimination, illegal conduct, or unsafe behavior. Violations may result in suspension or termination without refund.
4. Clothing-Optional Environment
The Retreat operates as a clothing-optional environment. Nudity may be present. Participation is voluntary and public indecency laws apply outside Retreat property.
5. Assumption of Risk
Members acknowledge inherent risks associated with participation and voluntarily assume such risks.
6. Release of Liability
To the fullest extent permitted by North Carolina law, Members release and hold harmless Wallace Haven, LLC; Blue Ridge Men’s Retreat; and its owners, officers, employees, contractors, and volunteers from liability except in cases of gross negligence or willful misconduct.
7. Membership Fees & Auto-Renewal
Membership fees are recurring and automatically renew unless canceled prior to renewal date. All fees are non-refundable unless required by law.
8. Suspension & Termination
The Retreat reserves the right to suspend or terminate membership at its sole discretion.
9. Governing Law
This Agreement shall be governed by the laws of the State of North Carolina. Venue shall be Rutherford County, North Carolina.
SECTION II — ENHANCED RIVER & POOL LIABILITY WAIVER
1. Acknowledgment of Inherent Risks
Use of the swimming pool and access to the Second Broad River involves risks including drowning, slipping, diving injuries, strong currents, submerged objects, uneven terrain, wildlife, weather-related hazards, and waterborne illness.
2. No Lifeguard on Duty
There may be no lifeguard on duty. Members are solely responsible for their own safety.
3. Alcohol & Impairment
Members agree not to enter pool or river areas while impaired by alcohol, drugs, or medication.
4. Assumption of Risk
Members voluntarily assume full responsibility for any injury, illness, property damage, disability, or death resulting from use of water-related facilities.
5. Release & Hold Harmless
Members release and hold harmless Wallace Haven, LLC and associated parties from liability arising from use of the pool, river, or surrounding areas except for gross negligence or willful misconduct.
6. Emergency Medical Authorization
Members authorize staff to contact emergency services if necessary and accept responsibility for related costs.
7. Indemnification
Members agree to indemnify Wallace Haven, LLC against claims arising from their actions.
8. Severability
If any provision is unenforceable, the remainder shall remain in effect.
